Warehouse worker's fall led to lifetime disability

Two warehouse operatives were standing on a stack of pallets to unload a container of boxes by hand from the back of a lorry. During this operation a large number of boxes fell from the container, knocking one of them to the ground, leaving them with serious head injuries and permanent disability.

An investigation found that an unsafe system of work was being used to unload the containers with insufficient measures taken to prevent falls. Furthermore a suitable and sufficient risk assessment of the activity had not been carried out.

The employer pleaded guilty and was fined £15,000, for breaching section 2(1) of the Health and Safety at Work etc Act and £3,500 for failing to carry out a risk assessment. Costs of £2,896 were also awarded.
