Ineffective guard led to arm loss
A Birmingham bakery was fined £25,000 following an accident in their Birmingham premises, which resulted in the amputation of an employee's arm.
An investigation found that, as a member of staff was cleaning a dough milling machine, his hand and arm were pulled between the moving rollers causing his arm to be trapped, forcing the emergency services to amputate his arm at the scene.
The investigation found that a guard in an upright position had allowed access to the moving rollers. An interlocking device, which should have prevented the rollers running with the guard raised, failed to operate because it was broken.
The machine's use had not been risk assessed.
The company pleaded guilty to charges under:
Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998 for failing to prevent access to the dangerous parts of a machine.
Regulation 3(1) of the Management of Health and Safety at Work Regulations 1999 for failing to carry out a suitable and sufficient risk assessment.
Full costs of £3,514 were awarded to Birmingham City Council.
